How the PVE Land Preservation Act differs from Parkland Deed RestrictionsThe PVE Land Preservation Act is a local law that requires voter approval before the City can rezone all Open Space. Parkland is a subset of Open Space, so it protects more land than just parkland. Some examples of Open Space that have no parkland deed restrictions include the Paseo Lunado median and the PV Drive West and North medians. Prior to the Land Preservation Act the City Council had the authority to rezone, develop and sell the land. The Preservation Act now requires voter approval to rezone this land. The County validated that Act received twice as many legal signatures as required. The PVE Land Preservation Act provides residents a voice with their vote.
